Terms & Conditions

By using the site and / or services in any manner, the customer agrees to be bound by these terms and conditions, and any and all other terms, conditions, rules, policies or procedures published on the site from time to time, related to the customer's use of the site and / or services, as amended from time to time by Zama Homes. If you do not agree to any of the terms contained herein or using the services, do not access or use this site or the services. As long as you do not cease using this site and the services, you will be conclusively deemed to have accepted these terms and conditions.

Booking a Reservation

Zama Homes acts as an online venue to offer, publish, lease, and book online different types of vacation rentals, short-time and long-time accommodation in Mexico.

Zama Homes uses its entire available means to offer accurate on-line availability calendars. However, we cannot guarantee that at the moment we will process your booking request, the booking request will still be valid. After a reservation has been made, Zama Homes reserves the right to reject your booking request and / or propose alternative solutions, without being responsible for any of the consequences to the customer. Any booking request made on the site is subject to Zama Homes's consent. Once receiving the booking request from the customer, Zama Homes will process the booking request, and send a final confirmation notice by email with the full reservation details: dates, apartment address, contact information and etc.

In addition, Zama Homes uses all means available to ensure that the booking request is maintained after the customer receives a final confirmation notice by e-mail. However, due to unforeseen circumstances or acts of God, the customer realizes and accepts that in any event the booking request cannot be fulfilled, the customer will be refunded the full amount paid or placed in a different apartment of an equal or higher standard, without consequences to Zama Homes.

Advance Payment

In order to book an apartment, the customer shall pay a down payment, as stated in his individual reservation form. Zama Homes cannot reserve a booking request and such reservation will not be considered valid until a down payment is made. After the down payment has been made, Zama Homes will send the final confirmation containing the order number, and receipt for payment. Before the final confirmation notice, Zama Homes may generate an email that informs the customer that Zama Homes received its booking request.

Method of Payment

The full cost of the reservation will be paid 7 days prior to the check-in date for all properties.

The customer shall present both his credit card which was used during the booking request and a form of identification. The owner of the credit card shall be present during check-in and it is not possible to show a different person's credit card and / or identification.

The remainder of the payment shall be made fully in cash or credit card without installments. For cash only - it is possible to pay in MXN, or USD according to the updated daily currency or according to Zama Homes's policy and the Mexican law.

Value Added Tax

All displayed prices do not include VAT.

Customers with foreign passports alone and without Mexican citizenship will receive an exemption from VAT after presenting their foreign passport and Tourist Visa upon check-in. Customers that do not have a foreign passport, or are holders of a Mexican passport, shall be charged VAT during check-in in accordance with Israeli law.

Cancellation

In the event the customer cancels the reservation in whole or in part after the confirmation email has been sent, Zama Homes shall apply the following:

  • 7 days or more before your check-in date - free cancellation
  • 6 days or less before your check-in date - 100% cancellation fee

    For Advance Purchase (Non-Refundable) reservations, these terms will not be applicable.

    For Monthly reservations (21 nights or more), these terms will not be applicable.

    Check-in

    Check-in time is from 3 PM (15:00) on the day of arrival.

    Check-out

    Check-out time is 11 AM (11:00) on the day of departure.

    Cleaning

    The customer will receive the apartment clean with clean lines and towels in the amount according to the number of people stated in the reservation form.

    Cleaning services and exchange of linens and / or towels are not included but are possible through coordination with Zama Homes. Such services shall be added to the final price according to a weekly or monthly rate.

    The apartment will be left in the same manner it was received, in a reasonable condition without excessive trash. Notwithstanding the above, Zama Homes may charge the customers' credit card extra payment if the apartment was not left in a reasonable condition.

    Prices

    The prices stated on Zama Homes's website are in MXN, or USD and are for one night (from 3 PM until 11 AM the following day) and include the use of the apartment according to these terms and conditions and according to the rental agreement. The prices vary according to the season, the length of stay, number of people, market situation, and / or according to Zama Homes policy. The prices are not fixed and may vary and be updated from time to time and discounts may be given according to occupancy at Zama Homes sole discretion. The prices on the site are not final and such prices will be final only after confirmation will be sent from Zama Homes to the customer.

    The price includes expenses such as water, gas, cables, electricity, internet, city tax, and the building superintendent.

    Damages

    In case any damages occur to the apartment or any of its assets, the customer shall immediately notify Zama Homes or its representatives.

    Liability

    Zama Homes cannot be held responsible for damages that may arise as a consequence of using the apartment, including without limitation, potential delays, accidents, damages (neither for personal nor for objects), insurance, and losses because of fires, robbery, calamity, plumbing, electrical, failure of appliances, gas or caused by water, ice, arising from the acts or neglects of other occupants of the building, or any owners or occupants or adjacent or contiguous property, or caused by the failure of wiring, lighting, heating, or cooling apparatus or damaged by theft or break-in or criminal behavior. Zama Homes and its employees are therefore not responsible for errors and omissions or any type of personal damages caused to any property and / or personal items, loss, theft, breaking and entering,injuries and / or accidents in the apartment or injuries while staying at the apartment, and will not be liable for any disputes between the customer and any third party. It is the Customers' sole responsibility to be responsible for himself, his property, and others staying in the apartment.

    Terms of Use

    The customer will be liable for the correct and decent behavior of all persons accompanying him. Should that person or any of the persons accompanying the customer will not behave in a suitable and responsible way, Zama Homes shall be entitled to request the customer and the persons accompanying him to leave the apartment without the customers' right to claim for any kind of compensation and / or damages.

    Customers are asked to cooperate according to the following:

    • It is not allowed to smoke in the apartment and / or the building area.
    • It is not allowed to light a fire in the apartment and / or building area.
    • It is not allowed to bring any pets and / or any other animal to the apartment and / or the area unless receiving prior written consent from Zama Homes.
    • it is not allowed to bring any drugs, weapons, flammable materials, and / or any other thing which may be considered dangerous to any person, property, and / or the environment.
    • The apartment is located in a residential area so please respect our neighbors and keep quiet.
    • It is not allowed to use the apartment for any commercial activities, parties, gambling, and / or any type of illegal activity. The apartment is intended for residential purposes only.
    • In the event the customer and / or any persons associated with the customer will not vacate the apartment after the term of their stay, the customer will be charged $ 400 for each additional night.

    Indemnification

    the customer holds Zama Homes exempt from any liability arising from any damage or injury that may occur to the customer and / or guests of the customer and their collective belongings originated by fixtures and / or structures of the apartment and / or the utilities supplied to the apartment.

    Change in Policy

    Since this policy may change over time as we modify or expand our services, we suggest that you check from time to time in order to understand how we treat your personal information. If we decide to change those policies, we will post those changes on this page so that you are always aware of what personal information we collect, how we use it, and under what circumstances we disclose it.

    Governing Law

    These terms and conditions are construed and enforced in accordance with the laws of the State of Mexico without giving effect to the conflict of law principles thereof. The competent courts of Cancun will have exclusive jurisdiction with respect to any dispute arising hereunder and the parties hereto hereby irrevocably submit to such jurisdiction

    Zama Homes has the right to change the terms of the company's policy at any given time.
